MINCIT publishes draft decree that would lift the ban on exporting thermal coal to Israel

The Ministry of Trade, Industry and Tourism published for public comment the draft decree “Repealing Decree 1047 of 2024 and Decree 0949 of 2025 and reinstating the general export regime for thermal coal classified under tariff subheading 2701.12.00.10.” The comment period for this decree runs from August 11 to 15, 2026.

The current restriction stems from Decree 1047 of August 14, 2024, which prohibited the export of this product subheading to the State of Israel, with exceptions for shipments already authorized, Supplier Certificates, and completed legal transactions, as well as a mechanism for accrediting established legal situations. A year later, Decree 0949 of August 28, 2025, made the measure absolute and repealed Articles 2 and 3 of the previous decree, eliminating both the exceptions and the registration requirement. A lawsuit seeking to annul this latter decree was filed with the Council of State and admitted in February 2026.

The project would repeal both decrees in their entirety, and its article 1 expressly excludes the revival of the provisions of Decree 1047 of 2024, to prevent the repeal of the 2025 decree from reinstating the prohibition with exceptions.

Article 2 states that exports of the subheading would be subject to the general regime, without restrictions based on the country of destination, without prejudice to applicable customs, exchange, tax, environmental and origin obligations, or prohibitions arising from binding resolutions of the Security Council.

Article 3 provides that pending operations continue under the reinstated regime and that ongoing sanctioning and confiscation proceedings for acts related exclusively to the prohibition are resolved by applying the principle of favorability of paragraph 4 of article 4 of Law 1609 of 2013.

The decree would take effect from its publication in the Official Gazette, invoking the exception of immediate validity of paragraph 2 of article 2 of that same law.

Thermal coal exporters and their logistics operators should monitor the final issuance of the decree and its publication date in the Official Gazette, as it would take effect immediately.
